Wills

Drafting a will provides you with the assurance that your family and loved ones will be provided for in the future in the way that you intend.

We can help guide you through the process of writing a will that meets your legal obligations and ensures your wishes are respected and help to avoid any mistakes that can result in costly court and estate administration costs for your family after your death, or increase the chances of claims being made against your estate.

At Scholefield Law we can assist you with drafting your will, advice on choosing executors, updating and reviewing your will, advice on dealing with previous and new relationships, marriage, separation and divorce, and dealing with businesses, farms and family trusts – all of those things that complicate estate planning.

We appreciate that modern families can be complicated.

Our will service is generally free of charge.

Enduring Power of Attorney

An accident or illness can strike at any time. Having an Enduring Power of Attorney will allow your family and loved ones to provide continuity in your day to day life, even when you are unable to make decisions for yourself.

An Enduring Power of Attorney allows someone you trust to have access to assist with the management of your assets and bank accounts to pay bills and to make decisions about your health and care including where you will live when you are unable to do those things for yourself.  We can also assist when you find that the situation has been left too late and there are capacity issues that affect your ability to make these decisions yourself.

Our Will and Estate Planning Lawyers can assist you to:

  • Prepare and draft your will tailored to your needs
  • Address the impacts of previous relationships, new relationships, step-children, grandchildren or no children.
  • Leave someone a life interest in a property
  • Hold assets in trust for minors or incapacitated beneficiaries
